In May, 2007, the governor of Arizona signed into law a bill increasing penalties for a DUI conviction, while creating a new "super extreme DUI" felony crime for drivers caught with a blood alcohol content (BAC) of .20 percent or higher. The super extreme DUI increases penalties, providing for higher fines and a minimum sentence of 45 days in jail. A judge may no longer suspend any part of the jail sentence. If you have a passenger in the car, you also face a felony charge of vehicular endangerment. One fact should be made perfectly clear — if your breath test, a blood test or a urine test indicates that you were driving with a BAC of .20 percent or higher, you face going to jail if convicted.
