First Time DUI Offense
Even if this is your first DUI offense, you still face 10 days of jail time, of which 9 can be suspended if you cooperate with and evaluation for alcohol or drugs and agree to receive treatment. You also face a $250 fine, plus an additional $500 prison construction fee. You can also have your driver's license suspended for 90 days up to a year and be required to undergo counseling.
Second Time DUI Offense
If this is your second or subsequent DUI offense, the range of penalties is more severe than for a first offense. You will face from 90 days up to six months of jail time. Sixty of the 90 days can be suspended, but this still means that you will have to serve 30 days in jail. Other consequences can include required us of an ignition interlock device; a fine of up to $2500, a prison construction fee of $500, mandatory counseling, and suspension of your license from 90 days up to a year.
